Hosting Terms of Service
Billing and Fees: Payment for hosting services is due on the first day of the service month for each type of billing period (monthly, quarterly, biannually, or annually).
Billing Periods begin at the first of each month. When you establish your hosting plan with us, you may not be signing up at the beginning of the month. If that is the case, you will be charged a pro-rated amount for the upcoming month, based upon when you began service.
Email reminder invoices are sent out 21 days before the beginning of your next billing period. Please note that you are responsible for payment regardless of whether you receive a reminder notice from us or not. Often people forget to let us know when an email address has changed, so please make sure your email address is kept current.
10% late payment fees are assessed if payment is not received by 5:00 pm PST on the fifth (5th) day of the month. We will suspend your account if payment is not received by the tenth (10th) day of the month. If your site has been suspended due to non-payment a $15.00 reinstatement fee must be paid before we can reinstate your site.
Making Payments: You may pay your invoice online at the hosting client area of our website using your client login and password.
Changing Hosting Plan or Period: You can easily change your hosting plan or billing period when you make your next payment online, as noted above in "Making Payments".
Cancellation of Web Hosting If for any reason you want to cancel your web hosting account please provide us with written notice by the 20th of the month. This notice can be sent by mail or by email. If you send the notice by email we will notify you that your notice has been received. If we do not notify you of receipt of your cancellation notice, that means we did not receive it, and you will still be responsible for payment of the following month's services.
Refunds for Pre-paid Hosting: If you are cancelling a pre-paid web hosting account we will refund the unused portion of your pre-paid hosting up to a three-month limit, upon your request. Please note that you must request a refund in your written cancellation notice in order for it to be honored; refunds are not automatic. Refunds will be issued to you through PayPal or Google Check-out, using the email address on file.
Operation of Your Website.We provide web hosting services, including availability of pre-installed "as-is" applications, but we do not guarantee that the operation of your web site will be uninterrupted or error-free. In no event will we be responsible to you or any third party for damages, including any lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate your web site and any web pages, even if we have been advised of the possibility of such damages.
No Tolerance Spam Policy: We do not tolerate spam, and do not allow anyone to send bulk e-mail, commonly know as spam, from or through their account. Any use of an account to send bulk e-mail is a material breach of our terms and your agreement to host with us and shall be grounds for immediate cancellation of your hosting account without notice. Any charges related to spam incurred to us will be charged to you. A minimum $25 service charge is assessed to any refunds issued when an account is cancelled for sending spam.
